This is a legally binding agreement so please read the Terms herein carefully. When you register it is mandatory that you click to accept the Terms Service “I Accept” or “Get Started” or “Proceed” button to use the Services. Use of the Site or any of the Services indicates your acceptance of these Terms without any conditions. If you do not accept these Terms then you must not browse around a Site nor use or any of the Services nor infringe on any Fennec Global copyrights, material, and material we license from others. You are not permitted to use, copy or pass-off on our intellectual property rights and other rights.

We may from time-to-time amend these Terms or anything else in this agreement without prior notice to you. The scope or content of the Services may also be changed by us from time to time. The updated agreement with the amended terms will be published on a Site and within the FennecSM Cloud. It is your responsibility to always check this agreement upon visiting a Site or making use of Services. Your use of a Site and/or the Services after such amendment indicates your acceptance of the amended Terms.

Breach of any of the Terms herein by you, may result in the termination of your account and or usage of this website or our Services or even a claim for damages or an injunction against you as a result of the breach.

1. Account Terms relating to use of Services
  1. In return for payment of the subscription fees, we agree to provide the Services to you on these Terms.
  2. You must register and to do so you must provide your real name and contact information and select a user login name (“login”) and password that will be required to access the Site –and the Services. You are responsible to keep your login name and password safe and secure and we are entitled to assume that all access to and use of the Site and the Services using your login and password is access and use by you.
  3. Your login credentials may only be used by one individual and a single login shared by multiple individuals is not permitted. If your Service plan allows you to create multiple users and logins because you are an administrator then this is permitted according to your purchase.
  4. We are not responsible for any loss or damage arising from your failure to comply with this security obligation.
3. Cancellation and Termination relating to Services
  1. If you wish to terminate your account you must notify us using our required account cancellation process. You are solely responsible for properly cancelling your account in timely fashion. An email or phone request to cancel your account is not effective or valid cancellation. The correct process to cancel your account is by clicking on the Upgrade button within the forecasting application on the top righthand side of the screen, and choosing the option Deactivate to terminate your account and then following directions as required.
  2. You should assume that all data associated with your account will be immediately deleted from the Service upon cancellation by you. This information cannot be recovered once your account is cancelled. We might retain some of your data purely as a gratuitous gesture mainly to coax you to re-join as a paying customer and continue building on the work you have created on the Cloud.
  3. There is no refund, no pro-rata, or credit of monthly fees for cancellation during a month. On annual payments you will be refunded for future months as we are not able to pro-rate the month in which you cancel.
  4. If you cancel the service before the end of the current paid up month, your cancellation will take effect immediately and you will not be charged again.
  5. Your permission to access the FennecSM website, information, data, tools and support will be deemed to terminate automatically if you breach any of our terms and conditions. We will always retain the sole and exclusive right to determine what is or is not deemed as breach.
  6. We always have the sole discretion in matters relating to our Sites and Services, and we may decline to provide Services to you or anyone for any reason, and may suspend or terminate your account and refuse any and all current or future access to or use of the Services for any reason at any time. Such termination of the Services will result in the deactivation or deletion of your Account or block your access to your Account.
7. General Conditions
  1. Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis.
  2. Technical support is only provided to paying account holders and is only available via email. Support is only available in English but we will try to accommodate other languages where possible. Paid Technical Support and Training is available to you if you purchase it using the Upgrade process and Marketplace within the Services.
8. Notices
  1. Any notice given under these Terms by either party to the other must be in writing by email and will be deemed to have been given on transmission. Notices to FennecSM must be sent to support@fennecsm.com or to any other email address notified by email to you from us. Notices to You will be sent to the email address which you provided when setting up your registration and access to the Service.
